IN NO EVENT SHALL SNOW FORECAST BE LIABLE UNDER THIS AGREEMENT FOR ANY CONSEQUENTIAL, SPECIAL, LOST PROFITS, INDIRECT OR OTHER DAMAGES, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, EVEN IF SNOW FORECAST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. SNOW FORECAST'S AGGREGATE LIABILITY UNDER THIS AGREEMENT FOR ANY CLAIM IS LIMITED TO THE AMOUNT RECEIVED BY SNOW FORECAST FROM ADVERTISER FOR THE BANNER ORDER GIVING RISE TO THE CLAIM

Banner Ad Promotions
The special rates above do not secure exclusivity on the page. Any sharing of the banner space will be on an equal 1:1 weighted basis, and the number of advertisers per page will not exceed four.

Snow Forecast reserve the right to terminate any banner advert agreement with 7 days written notice. Remaining sponsorship fee will be refunded.

Positioning: Except as otherwise expressly provided in the Banner Order, positioning of advertisements within the Snow Forecast web site or on any page is at the sole discretion of Snow-Forecast

Unless specified in the Banner Order, Snow-Forecast makes no guarantee with respect to usage statistics or levels of impressions for any advertisement. Advertiser acknowledges that delivery statistics provided by Snow Forecast are the official and definitive measurements of Snow Forecast's performance on any delivery obligations provided in the Banner Order.
